Primero. REVOCASE el fallo proferido por el Tribunal Superior del Distrito Judicial de Barranquilla, en virtud del cual se negó la protección solicitada. En su lugar, CONCÉDESE la tutela de los derechos fundamentales invocados por el pensionado y, en consecuencia, ORDENASE a la empresa Aerovías Nacionales de Colombia, S.A. Avianca que, en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente sentencia, pague al actor las mesadas pensionales dejadas de cancelar.
Segundo. SE ORDENARÁ a la compañía demandada que, en el futuro, hasta tanto la justicia laboral ordinaria no decida definitivamente la controversia entre el ISS y la compañía demandada sobre quién debe asumir el pago de la prestación social, o se llegue a un acuerdo entre ellos sobre el obligado a asumir la prestación, aquélla pague oportunamente las sumas adeudadas al actor por concepto de pensión convencional.
Tercero. Dése el trámite previsto en el artículo 36 del Decreto 2591 de 1991.
