- Primero. CONFIRMAR, por las razones expuestas en la parte motiva de esta providencia, las sentencias proferidas, en segunda instancia, por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala de Familia, al resolver las acciones de tutela intentadas por HUMBERTO GARCIA COLORADO, JAIME ALFONSO DUITAMA BARAJAS, JAIRO ENRIQUE VANEGAS ALVAREZ, CESAREO CARABALLO PULIDO, JOSE HECTOR CULMA PEÑA y JOSE ZARATE RUIZ.
- Segundo. REVOCAR la sentencia proferida por el Juzgado Penal del Circuito de Soacha y, en su lugar, CONFIRMAR la proferida por el Juzgado Promiscuo Municipal de Sibaté, dentro del expediente de tutela número 107.972 que corresponde a las acciones presentadas por GERMAN DIAZ PARRA, JOSE EDUARDO CORTES CARDONA, LUIS ANTONIO FUENTES HERNANDEZ y MARCO TULIO MENDEZ GONZALEZ.
- Tercero. LIBRENSE, por Secretaría, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
