Se interpuso la acción de tutela en contra de COLPENSIONES para alegar la vulneración de varios derechos fundamentales, en virtud de la expedición de actos administrativos en los que se reconoció a los accionantes la pensión de vejez, pero se determinó que el pago del valor del retroactivo estaría a cargo del empleador, esto es, el SENA.

Estimó la Sala que el amparo deprecado es IMPROCEDENTE, toda vez que no se cumplió con los requisitos de inmediatez y subsidiariedad.
