- Primero. Confirmar la sentencia proferida el 19 de octubre de 2001 por el Juzgado 14 Penal del Circuito de Bogotá y, en consecuencia, negar la tutela del derecho fundamental al debido proceso solicitada por la actora en el proceso que le adelanta la Fiscalía 21 Seccional de Socha por el delito de homicidio.
- Segundo. Disponer que, en el evento de que Hilda Inocencia Blanco Leguizamón sea encontrada responsable del delito de homicidio que se investiga, el juzgador tenga como parte cumplida de la condena la proporción de la pena que se le impuso por el delito de abandono de menores y que corresponde al aumento derivado de la muerte sobreviniente al abandono.
- Tercero. Dése cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
