Primero. REVOCAR el fallo del Juzgado
Quinto. Laboral del Circuito de Buenaventura. En su lugar CONCEDER la tutela y ORDENAR al Alcalde de Buenaventura (Valle) que en el plazo de 48 horas contados a partir de la notificación de la presente sentencia, se le cancelen al actor las mesadas pensionales correspondientes al año en curso. Se ordena también que en adelante se le paguen oportunamente. Si por la imprevisión administrativa no hubiere partida presupuestal disponible, las 48 horas se conceden para que se inicien los trámites correspondientes, con miras a efectuar las adiciones presupuestales que permitan el pago.
Segundo. Por Secretaría se librará la comunicación de que trata el artículo 36 el decreto 2591 de 1991, para los efectos del caso.
