Primero. REVOCAR el fallo proferido por el Juzgado
Tercero. Civil Municipal de Pasto. En su lugar TUTELAR el derecho fundamental a la subsistencia del señor Juan Higinio Rosero.
Segundo. ORDENAR al Gobernador de Nariño, si todavía no lo ha hecho, dentro de los quince (15) días siguientes a la notificación de la presente providencia, proceda a cancelar al actor la totalidad de las mesadas pensionales que le adeuda al momento de proferir este fallo, advirtiéndole que también podrá hacer uso del anticipo contemplado en el parágrafo 6º del artículo 2º de la ley 549 de 1999.
Se previene de nuevo al demandado para que no vuelva a incurrir en conductas como las que originaron la instauración de la acción de tutela en referencia.
Tercero. Por Secretaria, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
