- Primero. REVOCAR el fallo proferido por la Sala Laboral del Tribunal Superior del Distrito Judicial de Cucuta, mediante el cual nego la tutela solicitada.
- En su lugar, se CONCEDE el amparo del derecho al trabajo en condiciones dignas y justas. En consecuencia, se ordena al Departamento de Norte de Santander que, si ya no lo hubiere hecho, proceda dentro de las cuarenta y ocho (48) horas siguientes a la notificacion del presente fallo, a pagar los salarios dejados de cancelar a Elizabeth Rico de Gomez, siempre y cuando exista partida presupuestal disponible. En caso contrario, el indicado plazo se concede para iniciar y culminar los tramites presupuestales pertinentes, informando sobre las gestiones que se realicen al Tribunal de instancia.
- Segundo. PREVENIR a las autoridades demandadas para que adopten de manera permanente los correctivos tendientes a evitar que la falta de disponibilidad de recursos les impida el futuro cumplimiento de sus obligaciones patronales, y para que no vuelvan a incurrir en las omisiones ilegitimas que comprometen el minimo vital de los trabajadores, por el no pago oportuno de los salarios y prestaciones.
- Tercero. DAR cumplimiento a lo previsto en el articulo 36 del Decreto 2591 de 1991.
