- PRIMERO. REVOCAR la sentencia objeto de revision y en su lugar CONCEDER la tutela por haberse afectado el derecho fundamental al acceso a la administracion de justicia y al debido proceso.
- SEGUNDO. ORDENAR al Juzgado Penal del Circuito de Yopal que dentro del proceso penal del senor Mayermo Cruz, en el termino de 48 horas debe levantarse el acta de la audiencia publica, si es que no lo ha hecho. Y que, para efectos del turno para proferir sentencia, debe tenerse en cuenta la inicial fecha del 1deg de diciembre de 2000, segun se indico en la parte motiva.
- TERCERO. Librense por la Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
