- PRIMERO. REVOCAR el fallo de fecha 22 de mayo de 1995, proferido por el Juzgado Laboral del Circuito de Arauca y en su lugar NEGAR la acción de tutela interpuesta por el señor Jaime Bayona Benítez.
- SEGUNDO. ORDENAR a la Dirección de Impuestos y Aduanas Nacionales, seccional Arauca, continuar con el proceso administrativo No. DA95950001, iniciado el 6 de enero de 1995, suspendido por la decisión del Juez de primera y única instancia.
- TERCERO. ORDENAR que por la Secretaría General de esta Corporación, se comunique esta providencia al Juzgado Laboral del Circuito de Arauca, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
