Primero. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior de Pasto, y en su lugar TUTELAR el derecho fundamental a la igualdad de los senores Jesus Alirio de la Cruz Quintero, Eugenio Fabian Vallejo Realpe, Rosa Elena Cabrera Delgado y Rovira Esperanza Yaqueno Paz.
Segundo. ORDENAR al Alcalde Municipal de Tangua (Narino), para que en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de la presente providencia, proceda a cancelar a los demandantes los salarios a que tienen derecho de conformidad al Escalafon Docente al cual pertenecen.
Si no hubiere los recursos presupuestales suficientes para tal fin, dispondra del termino ya senalado para iniciar las gestiones tendientes a la obtencion de los mencionados recursos.
Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del decreto 2591 de 1991.
