- Primero. REVOCAR las sentencias dictadas por la Sala de Casacion Penal de la Corte Suprema de Justicia y Sala Penal del Tribunal Superior del Distrito Judicial de Santafe de Bogota de fechas 3 de marzo de 1998 y 4 de diciembre de 1997, respectivamente, en virtud de las cuales se denego la tutela impetrada.
- Segundo. CONCEDER a Fernando Tellez Lombana la tutela de sus derechos fundamentales al buen nombre y a la honra, la cual se hara efectiva, como se indica en los ordinales siguientes, en el termino de cuarenta y ocho (48) horas.
- Tercero. ORDENAR, en los terminos del numeral 3 de esta providencia, a los Juzgados 13 Penal del Circuito de esta ciudad y 5deg de Ejecucion de Penas y Medidas de Seguridad que a continuacion de las sentencias condenatorias proferidas contra quien uso el nombre e identificacion de Fernando Tellez Lombana, se haga constar que el condenado es persona distinta del abogado e historiador FERNANDO TELLEZ LOMBANA, portador de la cedula de ciudadania 79.405.691 de Bogota, peticionario de la tutela que se concede.
- Cuarto. ORDENAR que se oficie a la Division de Resena e Identificacion del Departamento Administrativo de Seguridad DAS, y a la Policia Nacional -Dijin, Sijin, con el fin de que elaboren o abran sendos folios o registros independientes, cada uno con la correspondiente cartilla decadactilar, al abogado e historiador Fernando Tellez Lombana, quien se identifica con la Cedula No 79.405.691 de Bogota, y a N.N. Alias Carlos Pineda Pena o Fernando Tellez Lombana, indocumentado, incluyendo en relacion con este ultimo las condenas proferidas por el Juzgado 33 Penal del Circuito y por la Justicia Regional de Santafe de Bogota, de que da cuenta la parte motiva de esta sentencia.
- Quinto. LIBRENSE por la Secretaria General de esta Corporacion, las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
