- Primero. REVOCAR la sentencia proferida por el Juzgado Doce Civil Municipal de Cartagena. En su lugar, TUTELAR los derechos fundamentales invocado por el demandante.
- Segundo. ORDENAR a la E.P.S. HUMANA VIVIR que, si aun no lo ha hecho, en el termino de las cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, de estricto cumplimiento a lo establecido en el Acuerdo 254 del 22 de diciembre de 2003, expedido por el Consejo Nacional de Seguridad Social en Salud, y proceda a practicar al actor el examen de carga viral, el cual ya fue incluido dentro de la reglamentacion del Plan Obligatorio de Salud por el citado acuerdo.
- Tercero. PREVENIR a la E.P.S HUMANA VIVIR, para que se abstenga de incurrir nuevamente en las conductas que en este fallo se han considerado violatorias de los derechos de los usuarios del sistema de salud.
