Primero. REVOCAR la sentencia proferida por el Juzgado Once Penal Municipal de Medellín de fecha 23 de diciembre de 2002. En su lugar, TUTELAR los derechos fundamentales a la vida, salud y seguridad social en condiciones dignas y justas, y a la integridad personal de la señora Ofelia Rueda Rincón.
Segundo. ORDENAR a COLSEGUROS E.P.S., que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta sentencia, se ordene la realización de las sesiones de quimioterapia y radioterapia que sean prescritas por el médico tratante de la señora Ofelia Rueda Rincón.
Tercero. COLSEGUROS E.P.S., podrá acudir al Fosyga para repetir por el equivalente al número de semanas faltantes, sin que el aludido tratamiento médico pueda ser supeditado a pago alguno por parte de la señora Rueda de Rendón.
Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
