- PRIMERO. CONFIRMAR la providencia proferida el 19 de Diciembre de 1991 por el Juzgado
- Primero. Superior de Tulua . Por las razones expuestas en la parte motiva de esta sentencia.
- SEGUNDO. En todos aquellos casos similares al presente por sus hechos o circunstancias, siempre que se omitan estudios de impacto y/o permisos de funcionamiento, por el ejercicio de actividades que amenacen contaminar el ambiente, la doctrina constitucional enunciada en esta sentencia tendra caracter obligatorio para las autoridades, en los terminos del articulo 23 del decreto 2067 de 1991.
- TERCERO. ENVIESE copia de este fallo al Senor Director del Instituto Nacional de Recursos Naturales Renovables y del Ambiente (INDERENA).
- CUARTO. ORDENAR que por Secretaria se comunique esta providencia al Juez
- Primero. Superior de Tulua ( Valle ), en la forma y para los efectos previstos en el articulo 36 del Decreto 2591 de 1991.
