- PRIMERO. REVOCAR la sentencia de segunda instancia proferida por el Juzgado 2º Civil del Circuito de Pitalito, el 3 de mayo de 1995.
- SEGUNDO. Conceder la tutela impetrada por Fernando Agustín Delgado Ordóñez, protegiéndole el derecho a la vida y por lo tanto a recibir agua para uso doméstico, del acueducto regional "La Cuchilla" de San Agustín. Consecuencialmente, la Junta Administradora de tal acueducto, representada por su Presidente, velará porque el agua sea primordialmente destinada al uso doméstico y regulará la distribución del agua que sobrare después de atender el uso doméstico adecuado; y el fontanero controlará la circulación del agua en tal forma que los usuarios la reciban en primer lugar y en forma debida para el consumo humano adecuado, y, por lo tanto la destinación del agua para lagos y fábricas solamente podrá ocurrir cuando haya exceso de liquido, previa autorización de la Asamblea General de los usuarios y siempre y cuando no restrinja el consumo domiciliario. En 48 horas se principiará a dar cumplimiento a las órdenes dadas en esta sentencia.
- TERCERO. Comisiónese al Juez de 1ª instancia para el cumplimiento de lo ordenado en el artículo 36 del Decreto 2591 de 1991.
- CUARTO. El Juez de 1ª instancia velará por el cumplimiento del presente fallo.
