La accionante comenta que le fue reconocida la pensión de sobreviviente debido al fallecimiento de su esposo, al momento de cancelarle las mesadas pensionales atrasadas le fueron descontados cuatro millones por concepto de aportes a seguridad social, alega que durante el tiempo que no le fueron canceladas la mesada ella realizó los respectivos aportes al sistema como independiente.
La Sala encuentra que la acción de tutela resulta improcedente por cuanto lo que se discute es una pretensión de orden económica y las controversias de índole legal escapan al radio de acción de garantías superiores.

- Primero. CONFIRMAR la sentencia proferida por la Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura, el 28 de septiembre de 2009, la cual modifico la sentencia proferida por el Consejo Seccional de la Judicatura de Cundinamarca, el 04 de agosto de 2009, declarando IMPROCEDENTE la accion de tutela interpuesta por la senora Celene Restrepo de Hurtado en contra de la EPS Sanitas SA y del Consorcio FOPEP 2007.
- Segundo. Por Secretaria General de la Corte, LIBRENSE las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991.
