- Primero. REVOCAR el fallo proferido por el Juez
- Cuarto. Laboral del Circuito de Cali.
- Segundo. CONCEDER la tutela por los derechos a la igualdad, al trabajo y a la estabilidad laboral reforzada como mecanismo transitorio para evitar un perjuicio irremediable. En consecuencia, ORDENAR a las propietarias del Colegio demandado, que a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, cancele a la accionante la indemnización prevista en el artículo 239 del Código Sustantivo del Trabajo, subrogado por el 35 de la Ley 50 de 1990.
- Tercero. El Colegio demandado reintegrará a la actora al empleo que desempeñaba, a más tardar dentro de los ocho (8) días siguientes a la notificación de este fallo, siempre que la trabajadora así lo desee.
- Cuarto. Serán responsable por el exacto e inmediato cumplimiento de este fallo, las propietarias del Colegio Rafael Pombo de la ciudad de Cali.
- Quinto. El desacato a lo aquí dispuesto dará lugar a las sanciones previstas en el artículo 52 del decreto 2591 de 1991.
- Sexto. Por Secretaria, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
