PRIMERO. REVOCAR la sentencia del Juzgado Quince (15) Penal del Circuito de Barranquilla, de fecha seis (6) de marzo de mil novecientos noventa y cinco (1995), que, a su vez, revocó en su totalidad el fallo proferido por el Juzgado Quince (15) Penal Municipal de la misma ciudad, el día veintitrés (23) de enero del presente año, y, en consecuencia, DENEGAR las dos (2) tutelas solicitadas por el doctor Pedro Antonio Turbay Salcedo, en relación con los establecimientos de comida rápida "Donde Oscar" y "Donde Yuli".
SEGUNDO. ENVIAR una fotocopia auténtica del proceso al Consejo Seccional de la Judicatura competente, a fin de que juzgue si el juez de
segundo. grado amerita algún tipo de sanción por el hecho de haber fallado con base en su propio conocimiento privado, en relación con la afirmación de que la jurisdicción contencioso administrativa estaba tramitando la acción de nulidad y restablecimiento del derecho radicada bajo el No. 8762.
TERCERO. COMUNICAR este fallo al Juzgado Quince (15) Penal Municipal de Barranquilla, para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
