- Primero. MODIFICAR la sentencia proferida el 18 de Diciembre de 2001 por el Juzgado
- Segundo. Civil del Circuito de Fusagasuga, Cundinamarca, en el sentido de CONCEDER la tutela solicitada, por vulneracion del derecho fundamental de peticion.
- Segundo. En consecuencia, ORDENAR al Ministerio de Defensa que en el termino de las 48 horas siguientes a la fecha de notificacion de esta sentencia resuelva de fondo la solicitud de reconocimiento de la pension de invalidez correspondiente al senor Javier Calderon.
- Tercero. Por Secretaria General, librese la comunicacion prevista en el articulo 36 del decreto 2591 de 1991.
