- Primero. REVOCAR la sentencia de abril 3 de 1997, proferida por la Sub-Sección D, Sección Segunda del Tribunal Administrativo de Cundinamarca, por medio de la cual se negó la tutela solicitada por el señor Juan Pulido Vega.
- Segundo. INAPLICAR el acto administrativo contenido en la comunicación de mayo 10 de 1996 del Ministerio de Defensa Nacional -División de Prestaciones Sociales, que negó a la compañera permanente del peticionario el derecho a la asistencia médica.
- Tercero. CONCEDER al peticionario la tutela del derecho a la igualdad. En consecuencia se dispone ORDENAR al Ministerio de Defensa -División de prestaciones sociales que proceda a suministrar a la compañera permanente del pensionado Juan Pulido Vega, siempre que se acredite esta condición, la asistencia médica que prevé el art. 113 del decreto 1214/90.
- Cuarto. ORDENAR que por Secretaría se hagan las comunicaciones a que se refiere el artículo 36 del Decreto 2591 de 1991.
