- Primero. REVOCAR la providencia expedida por el Consejo de Estado el 12 de marzo de 1998, por medio de la cual confirmó la dictada por el Tribunal Administrativo del Tolima el 5 de febrero del mismo año, en el sentido de rechazar por improcedente la acción de tutela iniciada por Jaime Ramón Forero Pimentel en contra de la Caja de Compensación Familiar de Fenalco del Tolima -Comfenalco-.
- Segundo. TUTELAR el derecho de petición del demandante y ordenar que, en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, la Caja de Compensación Familiar de Fenalco del Tolima -Comfenalco- responda la solicitud respetuosa hecha por el demandante el 19 de noviembre de 1997, relativa al otorgamiento de un subsidio de vivienda.
