- Primero. REVOCAR el fallo proferido por el Tribunal Administrativo de Sucre el diecinueve (19) de marzo de mil novecientos noventa y siete (1997), al resolver sobre la accion de tutela incoada por DORIS ISABEL CABARCAS VARGAS, contra la Secretaria de Educacion Nacional y el Alcalde Municipal de San Onofre -Sucre- y, en su lugar, CONCEDER la proteccion solicitada.
- Segundo. ORDENAR al Alcalde Municipal y al Secretario de Educacion Municipal de San Onofre que, en el termino de cuarenta y ocho (48) horas siguientes a la notificacion del presente fallo, procedan a evaluar la experiencia profesional acreditada por DORIS ISABEL CABARCAS VARGAS, para calificarla de nuevo, con miras a la futura provision de vacantes en las plazas docentes.
- Tercero. ENVIAR a la Procuraduria copia del expediente a fin de que sirvan investigar la conducta de los funcionarios que adelantaron el concurso para proveer las vacantes docentes a que se refiere la presente accion de tutela y en particular al Secretario de Educacion Municipal por no responder oportunamente al requerimiento de informacion que le hiciera esta Corporacion mediante auto del pasado 23 de julio.
- Cuarto. Por Secretaria librese la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991.
