- R E S U E L V E
- PRIMERO. REVOCAR la sentencia de marzo 18 de 1993, proferida por el Tribunal Superior del Distrito Judicial de Valledupar, Sala Civil.
- SEGUNDO. CONCEDER la tutela solicitada, por los motivos expuestos en esta sentencia y, en consecuencia, ORDENAR al Alcalde Municipal de la Jagua de Ibirico dar nuevamente trámite a la solicitud de amparo administrativo elevada por el CONSORCIO MINERO UNIDO S.A. a partir de la providencia admisoria de la acción, dentro de las 48 horas posteriores a la notificación de la presente providencia, de manera que sean respetados cabalmente los derechos fundamentales de defensa y debido proceso de las personas representadas por la peticionaria.
- TERCERO. LIBRESE comunicación al Juzgado Promiscuo del Circuito de Chiriguaná, con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
