- Primero. REVOCAR las sentencias de noviembre 21 de 1996 proferida por la Sala de Familia del Tribunal Superior del Distrito Judicial de Cali y de enero 28 de 1997 proferida por la Sala de Casacion Civil de la Corte Suprema de Justicia y, en su lugar, RECHAZAR por improcedente la tutela impetrada.
- Segundo. LIBRESE comunicacion a la Sala de Familia del Tribunal Superior del Distrito Judicial de Cali, con miras a que se surta la notificacion de esta providencia, segun lo establecido en el articulo 36 del Decreto 2591 de 1991.
