en nombre del pueblo y por mandato de la Constitución,
R E SU E L V E :
Primero. REVÓCASE la sentencia proferida por el Juzgado Promiscuo Municipal de Manaure, Guajira, el dieciséis (16) de diciembre de 1997, en la que se abstuvo de tutelar los derechos a la vida y a la seguridad social de LUISA MATILDE FREILES IBARRA, JULIO GREGORIO MENGUAL, JOSÉ FELICIANO FONSECA, MANUEL CIRILO VIDAL.
Segundo. ORDÉNASE al alcalde del municipio demandado que, si aún no lo han hecho, reanude el pago de las mesadas pensionales de LUISA MATILDE FREILES IBARRA, JULIO GREGORIO MENGUAL, JOSÉ FELICIANO FONSECA, MANUEL CIRILO VIDAL en el termino máximo de 48 horas contados a partir de la notificación de la presente providencia, so pena de las sanciones previstas en el Decreto 2591 de 1991 para el desacato y de acuerdo con lo expresado en la parte motiva de este fallo.
Tercero. PREVÉNGASE al Municipio de Manaure - Guajira para que evite volver a incurrir en las omisiones ilegítimas que originaron el presente proceso, so pena de las sanciones legalmente correspondientes.
Cuarto. COMUNÍCASE la presente providencia al juzgador de primera instancia para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
