Primero. CONFIRMAR la sentencia de la Corte Suprema de Justicia, Sala de Casación Civil y Agraria, de fecha tres (3) de febrero de mil novecientos noventa y nueve (1999), en la acción de tutela presentada por Yvonne Vélez Osorio y Fernando de Jesús Borrero Buenaventura contra Alejandro Estrada Villegas, con la adición de que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente decisión, el demandado se pondrá a disposición de la Corporación Autónoma Regional de Cundinamarca, CAR, para que con su colaboración y por su cuenta, se dé cumplimiento a las decisiones y actuaciones que adopte esa Corporación en orden a que se restaure, a la mayor brevedad, el cauce la quebrada a que se refiere la parte motiva de esta providencia.
Segundo. Por la Secretaría General de la Corte, enviar copias de esta sentencia a la Corporación Autónoma Regional de Cundinamarca y a la Alcaldía del municipio de La Calera.
Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
