en nombre del pueblo y por mandato de la Constitucion,
R E S U E L V E :
Primero. REVOCASE el fallo proferido por el Juzgado 42 Penal Municipal de Santa Fe de Bogota de fecha 4 de diciembre de 1997.
Segundo. CONCEDESE la tutela impetrada por HUGO ALBERTO MENA MURILLO, y, en consecuencia, se ORDENA al Director del Centro de Reclusion del Batallon de Policia Militar No. 13 de Puente Aranda, dar cumplimiento dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta providencia, al auto de fecha 24 de octubre de 1997 emanado de la Fiscalia Regional de Santa Fe de Bogota, mediante el cual se dispuso el traslado inmediato del accionante, a dicho centro de reclusion, con las seguridades requeridas, so pena de incurrir en las sanciones previstas en el Decreto 2591 de 1991, siempre que dicha orden se encuentre todavia vigente.
Tercero. Remitir copia de la presente providencia al Director del Instituto Nacional Penitenciario y Carcelario "INPEC", para que, bajo su personal responsabilidad, y de conformidad con las normas legales, adopte las medidas encaminadas al cumplimiento de la mencionada orden.
Cuarto. Librense por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
