- Primero. REVOCASE el fallo proferido en este proceso por el Juzgado 82 Penal Municipal de Santa Fe de Bogotá el 22 de enero de 1996.
- Segundo. CONCEDESE la tutela impetrada por CARMEN CENIT MACIAS DE MERCADO a nombre de su hijo, JAIRO MANUEL MERCADO MACIAS, y, en consecuencia, ORDENASE al Director del Instituto Nacional Penitenciario y Carcelario "INPEC" que, bajo su personal responsabilidad, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, adopte, previa evaluación de las condiciones de seguridad existentes, las medidas necesarias para la eficiente y real protección del detenido antes nombrado en guarda de sus derechos a la vida y a la integridad personal, bien en la Cárcel Nacional Modelo o en la de Policía de Facatativá.
- Tercero. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
