- PRIMERO. REVOCAR la sentencia proferida por el Juzgado Sesenta y Cinco Penal del Circuito de esta ciudad el treinta y uno (31) de marzo de 1995 y en su lugar DECLARAR IMPROCEDENTE la accion de tutela instaurada por los accionantes en contra del CLUB SOCIAL TELECOM por las razones expuestas en la parte motiva de esta providencia.
- SEGUNDO. Declarase que no hay lugar a ordenar la devolucion de los emolumentos pagados a los demandantes, que fueron materia de la accion promovida por los mismos.
- TERCERO. Librense por secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
