- PRIMERO. CONFIRMAR las sentencias de la Sala Civil del Tribunal de Medellin de 27 de octubre de 1994 y de la Sala Civil de la Corte Suprema de Justicia (29 de noviembre de 1994), por las razones expuestas en este fallo.
- SEGUNDO. Ordenar que por Secretaria de esta Corporacion se comunique esta providencia al Tribunal Superior de Medellin, Sala Civil, a fin de que haga las notificaciones y para los efectos previstos en el articulo 36 del decreto 2591 de 1991.
- CUARTO. Enviese copia de esta sentencia al Defensor del Pueblo, al Consejo Superior de la Judicatura, a la Procuraduria General de la Nacion.
