Primero. REVOCAR la Sentencia de la Sala de Casacion Civil y Agraria de la Corte Suprema de Justicia y, en su lugar, confirmar el fallo proferido en primera instancia por el Tribunal Superior de Buga -Sala Civil-, por medio del cual se tutelaron los derechos a la vida y a la integridad fisica del actor, y se ordeno al demandado reparar los danos existentes y acondicionar la oficina de archivos de que trata la demanda.
Segundo. DEJAR SIN EFECTOS la multa que se impuso al actor en el fallo de segunda instancia, pues su peticion fue legitima y desprovista de mala fe. Si ya el actor hubiere cancelado la suma correspondiente, o se le hubiere descontado parte de su sueldo por este concepto, se le reintegrara lo pagado o descontado sin dilacion alguna.
Tercero. DEJAR SIN EFECTOS la orden de iniciar una investigacion a los Magistrados de la Sala Civil del Tribunal Superior de Buga por su actuacion en el presente proceso. Para el efecto, se enviara al Consejo Superior de la Judicatura una copia de este fallo.
Cuarto. COMUNICAR esta providencia al Tribunal Superior del Distrito Judicial de Buga para los efectos del articulo 36 del Decreto 2591 de 1991.
