- PRIMERO. CONFIRMAR la sentencia de febrero 18 de 1993, proferida por la Sala Penal del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, en el sentido de rechazar la pretensión de desacuartelamiento del conscripto GUILLERMO JOSE AMAYA GIL pero conceder la tutela solicitada y, por tanto, ordenar al Director de Reclutamiento del Ejército Nacional disponer lo pertinente para que en su formación militar se respeten las recomendaciones médicas tendientes a proteger sus derechos fundamentales a la vida y a la igualdad.
- SEGUNDO. COMUNIQUESE al Tribunal Superior del Distrito Judicial de Santafé de Bogotá, el cual procederá a notificar este fallo a la autoridad militar y velará por su estricto y oportuno cumplimiento.
