- Primero. REVOCAR el fallo proferido por el Juzgado Promiscuo Municipal de Nobsa, el dos de agosto de mil novecientos noventa y nueve, al resolver sobre la acción incoada por Heriberto Vargas Carreño contra "Acerías Paz del Río" y el Seguro Social, y, en consecuencia, conceder la tutela en contra de la primera de las enunciadas entidades, negándola en cuanto a la segunda.
- Segundo. ORDENAR al Representante Legal de la empresa "Acerías Paz del Río" que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, realice las gestiones necesarias para la inmediata cancelación de todas las mesadas pensionales que se le adeudan a Heriberto Vargas Carreño y tome medidas para el cumplido pago de las mesadas futuras. Igualmente, en el mismo término deberá cancelar los aportes a la correspondiente EPS, y mientras la atención efectiva se inicia, deberá la empresa asumir todos los costos que, por atención de salud, requieran el pensionado y sus beneficiarios.
- El Seguro, en casos de urgencia o gravedad, prestará los servicios requeridos por el actor y su familia, y repetirá contra la empresa.
- Tercero. Por Secretaría LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
