- Primero. REVOCAR el Fallo proferido por el Tribunal Superior del Distrito Judicial de Barranquilla, Sala Unitaria Civil Familia, el diez de septiembre de 1999, al resolver sobre la acción de tutela incoada por José Alberto García Silvera contra la Personera Municipal de Usiacurí y, en su lugar, CONCEDER la protección solicitada.
- Segundo. ORDENAR a la Personera Municipal de Usiacurí resolver de fondo acerca de lo planteado por José Alberto García Silvera en su memorial del 21 de mayo de 1999, informándole acerca de las gestiones adelantadas para la vigilancia especial por él requerida, y, en su momento, sobre los resultados de aquéllas.
- Tercero. El incumplimiento de lo aquí dispuesto será sancionado en la forma prevista en el artículo 52 del Decreto 2591 de 1991.
- Cuarto. Por Secretaría, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
