- Primero. REVOCAR el fallo proferido el 24 de marzo de 2000 por el Juzgado
- Noveno. Penal Municipal de Barranquilla. En su lugar, CONCEDER la protección de los derechos fundamentales al trabajo en condiciones dignas y justas, a la igualdad y a la seguridad social a Jairo José Arenilla Rojas, Henry Rafael de Alba, Berenice del Carmen Epalza, Juana de Dios Orozco Villa, María de los Angeles Vargas Cardona, Concepción Astrid Gale de Torres, Jackeline Esther Gutiérrez Jiménez, Orfelina María Arroyo Gómez, Fanny Godoy Marriaga, quienes actúan por intermedio de apoderado.
- Segundo. ORDENAR a la sociedad Procesadora de Pastas del Caribe, Pastas Alimenticias Pugliese que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, cancele a los demandantes la totalidad de los salarios adeudados.
- Tercero. La sociedad Procesadora de Pastas del Caribe, Pastas Alimenticias Pugliese, asumirá todos los gastos médicos que eventualmente requieran los accionantes y sus beneficiarios, hasta tanto se ponga al día en el pago de los aportes por concepto de Salud al Instituto de Seguros Sociales.
- Cuarto. El desacato a lo ordenado en ésta providencia, se sancionará de conformidad con lo señalado en el artículo 52 del decreto 2591 de 1991.
- Quinto. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
