  1. en nombre del pueblo y por mandato de la Constitución,
  2. R E S U E L V E :
  3. PRIMERO. CONFIRMAR, por las razones expuestas en esta providencia, la sentencia proferida por la Sala Civil de la H. Corte Suprema de Justicia del veintiuno (21) de octubre de 1993, por medio de la cual se confirmó el fallo dictado por el Tribunal Superior de Santafé de Bogotá, que, a su vez, negó la acción de tutela interpuesta por el municipio de Santiago de Tolú en contra del Ministerio de Minas y Energía y la Empresa Colombiana de Petróleos-ECOPETROL.
  4. SEGUNDO. ORDENAR que por intermedio de la Secretaría General de esta Corporación se envíen copias de esta providencia al señor Ministro de Minas y Energía, al señor presidente de la Empresa Colombiana de Petróleos-ECOPETROL y al señor alcalde del municipio de Santiago de Tolú.
  5. TERCERO. ORDENAR que por la Secretaría General de esta Corporación, se comunique esta providencia a la Sala Civil del Tribunal Superior de Santafé de Bogotá, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
