- Primero. Declarar la Nulidad de todo lo actuado en el proceso de la referencia, desde el auto de fecha octubre
- primero. (1ro.) de mil novecientos noventa y dos (1992) que obra a folio 81 del expediente, inclusive.
- Segundo. Ordenar al Tribunal Superior del Distrito Judicial de Popayán, Sala Penal, que adelante el proceso en debida forma, conforme lo disponen los decretos 2591 de 1991 y 306 de 1992.
- Tercero. Devolver el presente expediente al despacho de origen para que se notifique el presente proveído al accionante y para dar cumplimiento a lo resuelto.
