- Primero. Confirmar los fallos adoptados por el Juzgado
- Segundo. Civil del Circuito y el Tribunal Superior del Distrito Judicial de Bogota en el tramite de esta accion de tutela, solo en cuanto resolvieron tutelar los derechos a la vida, la salud y la seguridad social de Elizabeth Uprimny Yepes.
- Segundo. Complementar esas sentencias, y ordenar al representante legal de la EPS CAJANAL, Seccional Bogota, que si aun no lo ha hecho, disponga lo necesario para que a la senora Elizabeth Uprimny Yepes se le proporcione oxigeno de manera constante, se le brinden las terapias de apoyo previas y posteriores al trasplante, se le realice el transplante de pulmon que requiere cuando se encuentre el donador apropiado y el equipo medico considere prudente realizar esa intervencion quirurgica, y en caso de cualquier urgencia -previa o posterior al trasplante-, la paciente sea remitida, para su atencion y tratamiento, al equipo interdiciplinario encargado de intervenirla. Todo lo anterior, so pena de las sanciones establecidas en el Decreto 2591 de 1991 para el desacato.
- Tercero. Prevenir a la EPS CAJANAL, Seccional Bogota, para que se abstenga de incurrir nuevamente en dilaciones injustificadas como la que se presento en el tramite de la autorizacion para los examenes pretransplante de la senora Uprimny Yepez, so pena de las sanciones previstas en el Decreto 2591 para el desacato.
- Cuarto. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
