Primero. REVOCAR el fallo dictado por el Juzgado
Sexto. Penal del Circuito de Barranquilla, de 22 de marzo de 2001. En su lugar, se TUTELA el derecho fundamental de petición a la accionante MARIA VARGAS DE REALES.
Segundo. ORDENAR, en consecuencia, al Jefe del Departamento de Atención al Pensionado del Instituto al Instituto de Seguro Social, Seccional Atlántico, que dentro del perentorio término de cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, si no lo hubiere hecho, responda la petición formulada por la señora MARÍA VARGAS DE REALES el 4 de abril de 2000, tendiente al reconocimiento de sustitución pensional a favor de su hija RUTH MERY REALES VARGAS. El Juez de instancia verificara en su oportunidad el cumplimiento de la orden.
Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
