  1. Primero. Confirmar la sentencia de fecha 21 de julio de 2004, del Juzgado
  2. Cuarto. Civil del Circuito de Santa Marta, en la acción de tutela instaurada por Isabel Daniel de Cantillo, Enilsa de Andreis Mattos, Alides Bado de Vásquez, Nubia Sánchez Castro, Josefa Guerra Yepes y Lucía Tejeda contra la Alcaldía del Distrito de Santa Marta, la Secretaría del Interior del Distrito y Dimar, Capitanía del Puerto de Santa Marta.
  3. Segundo. De acuerdo con lo expuesto en esta providencia, la Alcaldía de Santa Marta, la DIMAR y la Procuraduría General de la Nación, dentro de sus facultades, deberán propiciar una solución concertada con las demandantes de esta acción de tutela, solución encaminada a que se realicen los propósitos que la DIMAR busca con el despeje de la playa.
