Primero. REVOCAR la sentencia proferida el 10 de Julio de 2003 por el Tribunal Superior del Distrito Judicial de Tunja, Sala Penal, y, en su lugar, CONCEDER el amparo del derecho a la salud en conexidad con la vida digna del señor Orlando de Jesús Yépez Alzate, en la acción instaurada contra la Dirección del Complejo Penitenciario y Carcelario de Alta y Mediana Seguridad del Barne y el Director del Instituto Nacional Penitenciario y Carcelario - INPEC.
En consecuencia, ORDENAR al Director del Complejo Penitenciario y Carcelario de Alta y Mediana Seguridad del Barne que, dentro del término de cinco (5) días hábiles contados a partir de la notificación de este fallo, adelante los trámites administrativos tendientes a obtener los recursos para el suministro de la prótesis dental requerida por el peticionario, con el fin de que, se le coloque la misma, de conformidad con las prescripciones odontológicas correspondientes y en el término mínimo que la ciencia odontológica necesite para ejecutar esta orden que será determinado por el odontólogo tratante.
Segundo. Por Secretaría, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
