- Primero. REVOCAR la Sentencia del Juzgado Treinta y Siete Civil del Circuito de Bogotá, dictada en este proceso el 5 de octubre de 1999.
- Segundo. TUTELAR los derechos constitucionales a la vida digna, a la salud, a la integridad, y a la seguridad social de José Gustavo Pasito Espitia y, en consecuencia, ORDENAR al Seguro Social, Seccional Santa Fe de Bogotá que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, autorice, si aún no lo ha hecho, la cirugía de reemplazo total de la cadera derecha al demandante, la cual deberá efectuarse previo dictamen médico, bajo la responsabilidad profesional de los facultativos que lo traten y en la oportunidad que ellos indiquen.
- Tercero. PREVENIR al Seguro Social para que en el futuro se abstenga de observar las conductas reprochadas en este fallo, que inciden en la salud y amenazan la vida de sus pacientes.
- Cuarto. REMÍTANSE copias de esta providencia y del expediente al Procurador General de la Nación para lo de su competencia.
- Quinto. Por Secretaria, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
