- Primero. REVOCAR las sentencias proferidas por los Juzgados Veintitres Civil Municipal y Once Civil del Circuito de Bogota, el 16 de junio y 22 de julio de 2003, respectivamente
- Segundo. CONCEDER la tutela impetrada por el senor Oscar Hernan Rincon, en su propio nombre y en el de su hija Laura Esperanza Rincon Munoz y, en consecuencia ORDENAR a Compensar E.P.S., que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, otorgue la licencia a que se refiere el numeral 4deg, del articulo 34 de la Ley 50 de 1990, la cual se extiende por ministerio de la ley al padre adoptante sin conyuge o companera permanente y, en tal virtud, con mayor razon al padre biologico que se encuentra en las mismas circunstancias facticas, como quiera, que en donde existe la misma razon de hecho debe ser aplicada la misma solucion en derecho.
- Librense por Secretaria, las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
