- Primero. CONFIRMAR el fallo proferido por el Juzgado
- Segundo. Penal del Circuito de Cartagena el día ocho (8) de septiembre de mil novecientos noventa y cinco (1995), al resolver en segunda instancia sobre la acción de tutela interpuesta por ELZAEL BARRIOS, por medio de apoderado especial.
- La tutela se entiende concedida contra el Inspector que suscribió la Resolución 018 del 13 de febrero de 1995, por violación del debido proceso, pero debe ser cumplida por quien, al momento de notificar esta providencia, ejerza el cargo.
- Segundo. ENVIESE copia del expediente y de esta providencia a la Fiscalía General de la Nación, para lo de su cargo.
- Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
