- Primero. REVOCAR la sentencia dictada por la Sala Civil del Tribunal Superior de Bogotá el 21 de julio de 2000.
- Segundo. TUTELAR el derecho a la vida del señor Fabian Gerardo Borraez Gaona y, en consecuencia, ordenar a la E.P.S. Humana Vivir S.A. suministrarle los medicamentos requeridos para el tratamiento del VIH Sida, según la prescripción de su médico tratante, en la dosis por éste recomendada y cuantas veces sea necesario.
- Tercero. INAPLICAR por inconstitucional, para el caso concreto, según lo expuesto en la parte motiva de esta sentencia, el artículo 17 de la Resolución No. 5261 de 1994.
- Cuarto. La E.P.S. Humana Vivir S.A. podrá repetir contra el Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud por el porcentaje en semanas que le falten al usuario para el mínimo de las cien semanas.
- Quinto. PREVENIR a Humana Vivir S.A. para que en adelante no omita suministrar los tratamientos y medicamentos en principio excluidos del plan obligatorio de salud por la legislación, en casos en los que, como el presente, proceda claramente su inaplicación.
- Sexto. Líbrese por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
