- Revocar la sentencia del Tribunal Superior de Medellín, Sala Civil, de fecha diez y siete (17) de octubre del dos mil dos (2002), en la tutela presentada por Emilse de Jesús Jaramillo Parra contra la Dirección Seccional de Salud de Antioquia y la ARS Comfamiliar Camacol. En su lugar, se declara improcedente la acción por indebida legitimidad activa.
- Se advierte que en relación con una situación futura, si el titular de los derechos fundamentales, señor Jaime de Jesús Jaramillo Ramírez, considera que las entidades responsables de atender sus requerimientos de salud, le están vulnerando algún derecho fundamental, puede interponer directamente acción de tutela, o si existe prueba que no se encuentra en condiciones de promover su propia defensa, puede acudir a un agente oficioso, tal como lo dispone el artículo 10 del Decreto 2591 de 1991.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
