- Primero. REVOCAR la sentencia proferida por la Sala Plena del Tribunal Administrativo de Bolivar. En su lugar CONCEDER la presente tutela por violacion del derecho fundamental al pago oportuno de las mesadas pensionales.
- Segundo. ORDENAR al Departamento de Bolivar, representado por el senor Gobernador, para que en el termino maximo de un (1) mes, contado a partir de la notificacion de la presente sentencia, proceda, si aun no lo ha hecho, a cancelar al demandante las mesadas pensionales correspondientes a los meses de julio, agosto y septiembre de 1998, siempre y cuando disponga de los recursos presupuestales para ello. Si no los tuviere, dispondra del mencionado termino para iniciar los tramites correspondientes a fin de lograr la consecucion de dichos recursos, y proceder de esa manera a cancelar al actor las mesadas pensionales ya senaladas.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
