- PRIMERO. CONFIRMAR parcialmente el fallo proferido por el Tribunal Superior del Distrito Judicial de Pasto -Sala Penal- el 13 de agosto de 1993, pero reformándolo en sentido de que la tutela se concede como mecanismo transitorio para evitar un perjuicio irremediable.
