Primero. REVOCAR la sentencia proferida por la Sala Laboral de la Corte Suprema de Justicia y, en consecuencia, conceder la tutela del derecho fundamental a la seguridad social del demandado, por haberse comprobado una lesión al mínimo vital de una persona de la tercera edad.
Segundo. ORDENAR al representante legal de la empresa "INDUSTRIA HULLERA S.A." que, dentro de las 48 horas siguientes a la notificación de la presente sentencia, pague las mesadas pensionales que, con ocasión de la huelga, dejó de cancelar a Luis Alberto Rivera Rivera.
Tercero. ORDENAR al representante legal de la "INDUSTRIA HULLERA S.A.", que adelante los trámites de afiliación de los pensionados de la empresa a un fondo de pensiones, a fin de evitar que se repitan los hechos que dieron lugar a la presente tutela.
Cuarto. COMUNICAR esta providencia, por medio de la Secretaría General, al Tribunal Superior del Distrito Judicial de Medellín, para los fines de que trata el artículo 36 del Decreto 2591 de 1991.
