Demanda de inconstitucionalidad contra la Ley 1695 de 2013, por medio de la cual se desarrolla el artículo 334 de la Constitución Política y se dictan otras disposiciones.
El demandante considera que la ley acusada, es inconstitucional en su integridad, pero propone cargos sobre un aparte específico de la norma.
Los cargos alegados son la vulneración del concepto de Estado Social de Derecho, la violación del fundamento de la acción de tutela, la trasgresión de la autonomía de las entidades territoriales y la contravención del principio de sostenibilidad fiscal.
La Corte concluye que ninguno de los cargos cumple con las condiciones de certeza, suficiencia y pertinencia, y, en consecuencia, decide INHIBIRSE de emitir un pronunciamiento de fondo, por ineptitud sustantiva de la demanda.
